ORLANDO, Fla. (AP) ? The former neighborhood watch leader charged with fatally shooting Trayvon Martin was confused and fearful when he and his wife misled court officials about their finances during an April bond hearing that allowed him to be released from jail, his attorney said Monday.

Attorney Mark O'Mara wrote on a website run by George Zimmerman's legal team that he will ask for another bond hearing. A day earlier, Zimmerman returned to jail because his $150,000 bond was revoked by a Florida judge after prosecutors claimed Zimmerman and his wife, Shellie, deceived the court during the bond hearing.

At the hearing, Shellie Zimmerman testified that the couple had limited funds for bail because she was a full-time student and her husband wasn't working. Prosecutors say Zimmerman actually had raised $135,000 in donations from a website he created.

Circuit Judge Kenneth Lester ordered Zimmerman returned to the Seminole County Jail, and Zimmerman complied Sunday afternoon. Zimmerman had been hiding in an undisclosed location for safety reasons.

"While Mr. Zimmerman acknowledges that he allowed his financial situation to be misstated in court, the defense will emphasize that in all other regards, Mr. Zimmerman has been forthright and cooperative," O'Mara said.

Zimmerman will remain in jail at least until next Monday because the judge will be out of court this week and has no hearings scheduled.

Zimmerman is charged with second-degree murder for fatally shooting Martin during a confrontation in a Sanford, Fla., gated community where Zimmerman lived and where Martin was visiting. He has pleaded not guilty and is claiming self-defense. The delay in his arrest for 44 days led to protests nationwide and led to intense debate about self-defense laws and race. Martin was black; Zimmerman's father is white and his mother is from Peru.

Prosecutor Bernie De la Rionda presented to the judge last week a partial transcript of telephone conversations Zimmerman had with his wife from jail, days before the April 20 bond hearing. Zimmerman and his wife discussed the amount of money raised from the website, and Zimmerman spoke in code to tell his wife how to make fund transfers, according to the transcript. The code referred to amounts of "$15" in place of "$150,000."

When Shellie Zimmerman was asked at the bond hearing how much money was raised from the website, she said, "Currently, I do not know."

O'Mara acknowledged that the phone calls make clear Zimmerman knew a lot of money had been raised by the website. But Zimmerman's judgment was clouded by threats to his safety that required him to stop working and forced Zimmerman and his family to leave their homes, the lawyer said.

"We feel the failure to disclose these funds was caused by fear, mistrust, and confusion," O'Mara said.

Of the $204,000 raised from the now-defunct website, $150,000 is under the administration of an independent third party. About $30,000 was used to help Zimmerman go into hiding after he was released from jail in April. The remaining $20,000 was kept in cash to help with the Zimmermans' living expenses. A separate website started by O'Mara has raised $37,000.

The revocation of Zimmerman's bond could impact his case in several ways, legal experts say.

If the judge refuses to grant bond a second time, O'Mara is under pressure to move the case along because his client will be sitting in jail, not his own home.

The bond problem also could influence the judge's opinion of Zimmerman's credibility if there is a "stand your ground" hearing. Such a hearing, before the judge and with no jury, would give Zimmerman the chance to argue he killed Martin in self-defense under the Florida law that gives wide latitude to use deadly force rather than retreat in a fight if people believe they are in danger of being killed or seriously injured.

If there is a trial, prosecutors, under certain circumstances, may be able to cite the bond hearing to raise questions about Zimmerman's credibility in a case in which he is going to need to convince a jury about his version of what happened during the confrontation.

"The gravity of this mistake has been distinctly illustrated, and Mr. Zimmerman understands that this mistake has undermined his credibility, which he will have to work to repair," O'Mara said.

AFP - Rajon Rondo sparked Boston after top scorer Paul Pierce had fouled out in over-time as the Celtics beat Miami 93-91 to level their NBA playoff series.

Pierce scored 23 points while Rondo added 15 points and 15 assists as the Celtics evened the best-of-seven Eastern Conference final at 2-2 with game five on Tuesday at Miami and game six back in Boston on Thursday.

Either the Heat or the Celtics will face the Western Conference champions, the San Antonio Spurs or Oklahoma City Thunder, in the NBA Finals starting on June 12.

After regulation time ended in a deadlock at 89-89, stars became spectators as Pierce fouled out, collecting his sixth violation 38 seconds into over-time to foul out for the third time in five playoff games.

"When your leading scorer goes out, you have got to step up and make plays," Rondo said. "That's what we did."

Miami's LeBron James, who scored a game-high 29 points, fouled out with 1:51 remaining, the first time he had fouled out since leaving the Cleveland Cavaliers and joining the Heat two years ago.

"It was like chess. They took our queen and we took their queen," Celtics guard Ray Allen said. "All that has to happen is the game has to be won. It doesn't matter what it looks like."

Kevin Garnett added 17 points and 14 rebounds for the Celtics while Allen contributed 16 points. Dwyane Wade scored 20 points for Miami while Udonis Haslem had 12 points and 17 rebounds for the Heat.

Haslem's slam dunk gave Miami a 91-89 lead early into over-time.

But Boston's Marquis Daniels hit 1-of-2 free throws and Rondo sank a jumper to put the Celtics on top 92-91.

Rondo also made 1-of-2 from the free throw line with 21.4 seconds to play to give Boston a 93-91 edge with Miami taking the ball.

Wade elected to try a 3-point shot for the victory and evaded Daniels to create an open opportunity beyond the arc.

"I thought it was going in when it left his hand," Celtics coach Doc Rivers said.

But Wade's shot clanked off the rim and the final buzzer sounded.

"We knew they were going to Wade," Rondo said. "We played good defense on him and got the stop. We executed offensively, came up with some lucky plays and got some stops at the end."

James, the NBA Most Valuable Player still searching for his first NBA title, was fuming in the locker room about the foul calls that forced him to the bench with the outcome still undecided.

"I don't foul out," James said. "That sixth foul, I wish I had earned it. It would have been a foul (by) me. I know how to play basketball. I don't need the advantage of pushing somebody down or holding somebody, but whatever.

"We have to build off our mistakes, off good and bad things from the last two games. We've just got to come out with a sense of urgency. The last two games they have hit us hard. The post-season is all about adversity."

The Celtics led by as many as 18 points in the first half and 16 in the third quarter.

"They hit a lot of shots in the first half," the Heat's Mario Chalmers said. "Our defense wasn't as crisp as it normally is. In the second half we turned it up. We just kept trying to push the ball, get back into our game."

The Heat took a 76-74 lead early in the fourth quarter with a 15-1 run that was capped by a layup from rookie Norris Cole.

"We came out in the second half and tried to throw knockout punches," Rivers said. "Our execution in the first half was flawless, as well as we've ever had. In the second half, we got away from that and Miami took us out of our air space."

Garnett sank an inside shot for an 89-86 Boston lead but James answered with a 3-pointer 15 seconds later to pull Miami level again. The Heat had the final shot of regulation time but Haslem missed a jump shot at the buzzer.

"No one said this was going to be easy," Heat coach Erik Spoelstra said. "In the second half we got into the grind and into the fight," he added.

Bankruptcy lawyers resist scrutiny over fees

WASHINGTON (Reuters) - The bankruptcy lawyers who handle the biggest U.S. corporate restructurings responded with hostility on Monday to new scrutiny of their fees, which can reach hundreds of millions of dollars at the expense of creditors.

The lawyers told officials of the U.S. Justice Department they do not want to keep a budget, they do not want to disclose details of their billing practices and they do not want to justify expenses under $500.

The lawyers tried to make their case on the 7th floor of Washington's Justice Department at a rare public meeting called to consider whether bankruptcy fees are inflated, unjustified or wasteful.

The airing of ideas took place amid tales of limousine rides and clothing put on expense accounts, and in the face of questions about what exactly lawyers do to bill at rates up to and above $1,000 an hour.

In one recent example, during the two-and-a-half-year restructuring of Lehman Brothers, payments to the law firm Weil Gotshal & Manges totaled $383 million, according to a securities filing in March.

Legal fees are at issue also in the bankruptcy of MF Global Holdings Inc, whose estate has paid $17 million to lawyers in four months, according to court filings on Monday.

Bankruptcy lawyers bill at higher rates than lawyers in most other specialties, although the reason is in dispute. The top billers say the market values their experience and knowledge in restructuring companies such as Chrysler Group LLC. Critics say it is because managers of bankrupt companies are less aggressive than other clients in asking for discounts.

The Justice Department's U.S. Trustee Program is considering changes designed to impose what it considers financial discipline.

INACCURATE DATA

At Monday's meeting, lawyer Richard Levin said the data that the U.S. Trustee Program wanted to collect about hourly rates would be useless. He said legal billing records often were inaccurate because he and colleagues forgot to write down time they spent on cases.

"Lawyers are notoriously bad at administrative tasks, including putting data in properly," said Levin, a partner at Cravath, Swaine & Moore in New York and vice chairman of trade group the National Bankruptcy Conference.

In bankruptcy cases, lawyers' fees are at the mercy of the bankruptcy courts. Lawyers submit applications for compensation and objections may come from creditors, many of whom lose out in a bankruptcy, or from trustees, who are federal officials.

The final decision on fees is up to a bankruptcy judge, guided by what U.S. law says is "necessary" and "reasonable."

The U.S. Trustee Program wants to know whether law firms inflate their rates in bankruptcy cases ? for example, by using more lawyers than necessary, or by dragging their feet ? knowing they are unlikely to be challenged by the court.

"It cannot possibly be, can it, that everyone works through budgets except bankruptcy lawyers?" asked Clifford White, director of the Executive Office of U.S. Trustees.

Damian Schaible, one of five private lawyers who answered questions in person from White and his staff, said the process of budgeting was often useless, especially in the context of a legal team working on an unpredictable bankruptcy.

"How can anyone budget in the real world what they're going to spend?" asked Schaible, a partner at Davis Polk & Wardwell in New York, dismissing budgets also in personal bankruptcies.

LARGE FIRMS' DNA

Big law firms, which can throw scores of lawyers at a single case, cannot help but splurge on a major bankruptcy, said Albert Togut, managing partner of a boutique law firm that specializes in bankruptcy.

"It's in their DNA that, when they approach a project, they bring every resource at their disposal to the project," he said.

He urged the trustee staff to make a change that would encourage greater use of small, specialized law firms.

There has been a disproportionate number of major bankruptcy cases in recent years ? including Lehman, General Motors, Washington Mutual ? and the proposed new scrutiny from the U.S. Trustee Program is aimed at big cases, those with combined assets and liabilities of $50 million or more.

But there is disagreement even on that threshold. A group of 118 law firms opposed to the trustee proposal wants to set the line at $250 million.

A lawyer was scheduled to speak on behalf of those 118 firms on Monday, but he did not appear. D.J. "Jan" Baker of Latham & Watkins had, in written comments, assailed the trustee proposal as illegal and wasteful.

Baker preferred to meet in private, White said, adding that he was disappointed by the absence.

"Private meetings do not afford the level of transparency that today's meeting will provide," he said early on.

Baker did not respond to a request for comment later on Monday.
